Definitions

'Promoter' means Scratch'n'Win, Lotterywest, 74 Walters Drive, Osborne Park Western Australia 6017 ABN: 78531150466

'Terms and Conditions' means the Terms and Conditions of the Promotion.

'Promotion' means 75th Anniversary.

'Major Prize' means ten prizes of $75,000. Total prize pool is $750,000.

'Eligible to Enter' means Entrant must be 16 years or over and reside in the state of Western Australia.

'Entry Form' is an online entry that is on the Promoter's website www.celebrate75.com.au

'Valid Entry' is an entry where the online Entry Form has been filled out correctly and submitted successfully via the website www.celebrate75.com.au. An entry is deemed to be successful when it includes a unique, eligible/valid 13-digit $2, $3 or $5 special 75th ticket number, the entrant is 16 years or over, and the Terms and Conditions have been agreed to.

1. Entry and other instructions contained within promotional material form part of these Terms and Conditions. By participating in this Promotion entrants agree to be bound by these Terms and Conditions.
2. The Promotion will run from 9am, Saturday 02 August 2008 until 9am Wednesday 17 September 2008 inclusive. The draw will take place at 12pm, Wednesday 17 September 2008 at Lotterywest head office, 74 Walters Drive, Osborne Park.
3. How to enter: Entrants must purchase any $2, $3 or $5 Special 75th scratchie ticket. They must then complete the online Entry Form at the website www.celebrate75.com.au, including the 13-digit ticket number from their scratchie ticket. Entry can only be made via the online Entry Form.
4. Entrants may enter as many times as they like during the promotional period however a ticket number can only be entered once. Multiple entries require multiple ticket purchases.
5. A $2 ticket entitles entrant to two entries. A $3 ticket entitles entrant to three entries. A $5 ticket entitles entrant to five entries.
6. Entries must be submitted online at www.celebrate75.com.au before 9am Wednesday 17 September 2008 to be eligible for the Major prize draw.
7. All 75th scratchie tickets must be retained for presentation to Lotterywest should you win a prize from the normal ticket play. Both winning and non-winning tickets will be accepted into the promotion however if you chose to enter a winning ticket you will not be able to collect your win until after the promotion has finished as you are required to produce the ticket for verification. (Retailers are required to dispose of any winning tickets once they have paid out on them so you will not have it available for validation should you win a prize in the promotional draw.)
8. The major prize winning entries will be deemed to be the first ten Valid Entries drawn, however a winning ticket must be presented for a prize to be issued.
9. The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise contact details provided by an entrant. The Promoter is not responsible for lost, interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
10. The Promoter reserves the right, in its sole discretion, to disqualify any individual for:
    1. Tampering with the entry process, including exceeding any limitation on the numbers of entries, or any other process as determined by the Promoter that in any way affects the fairness of the promotion;
    2. Tampering with the operation of the competition or web site; or
    3. Acting in violation of these terms and conditions.
11. There are ten (10) Major Prizes to be won of $75,000 each. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variation in item values. The winner is responsible for any and all taxes payable as a result of a prize being awarded or received.
12. The prizes are not transferable.
13. To collect their prize, winners must produce their eligible $2, $3 or $5 Special 75th scratchie ticket with numerical code matching the online entry and show identification at the Lotterywest head office at 74 Walters Drive, Osborne Park 6017.
14. Two forms of identification, including one item of photo identification must be shown in order for the prize winner to collect their prize.
15. Prizes must be collected within 28 days of the date of the draw. Any prizes not claimed by this time will be forfeited. Lotterywest reserves the right to use any forfeited prizes for other Promotions.
16. It is a condition of entry that Lotterywest has the right to publicise the names, characters, likenesses or voices of any contestants for any promotion or matter incidental to the Promotion. The results of the Promotion will broadcast on Channel 10, as such it is a condition of entry that Lotterywest reserves the right to broadcast the names and details of all winners drawn.
17. Lotterywest, their advertising agencies, their affiliates, sponsors or representatives absolve themselves of any and all liability, financial or resultant arising out of, or in connection with, any contest staged by Lotterywest.
18. Lotterywest accept no responsibility for any accident, loss, injury or damage to any individual or property arising out of or in conjunction with the competition either during or after the competition.
19. The prize winners will be notified by telephone and verification of the ticket must take place before the broadcast on Channel 10. As such winners must be contactable within 12 hours of the draw (draw takes place 12pm Wednesday 17 September 2008). If the winner cannot be contacted within this time a redraw will take place.
20. All prize winners must make their own way to Lotterywest to collect their prize.
21. In all matters, all decisions of Lotterywest and staff will be final and cannot be contested. No correspondence or discussions will be entered into.
22. Employees of Lotterywest, their agencies or companies associated with this promotion and their immediate families are ineligible to enter this competition.
23. Staff, Owners and Directors of Lotterywest licensed retailers and their immediate families are all ineligible to enter this Promotion.
24. Immediate family includes spouse, defacto spouse, parent, natural or adopted child and sibling.
25. Where you provide us with an email address we may use it at any time in the future to contact you with special offers that may be of interest to you. You confirm that you are the email account holder or a nominee of that person to enable you to give this consent.
26. Promoter reserves the right to cancel this Promotion at any time prior to the commencement of the Promotion Period for any reason whatsoever.
